TOWARD JUDICIAL INDEPENDENCE AND ACCOUNTABILITY IN AN EMERGING DEMOCRACY THE COURT AND THE CONSOLIDATION OF DEMOCRACY IN GHANA by Kwasi Prempeh.pdf
The essay focuses on the role of the courts, particularly the Supreme Court, in the ongoing search for democracy and constitutionalism in Ghana. Mr Prempeh notes that the Supreme Court's power of judicial review makes it a vital institutional watchdog in the Fourth Republic. He cautions that the power vested In the Supreme Court to determine the constitutionality of legislative and executive decisions may not always serve the interests of democracy and that the judicial review could undermine, rather than promote, democracy if it is used to lend judicial imprimatur and legitimacy to undemocratic actions of the government. Mr Prempeh argues that because of this double-edged character of judicial review, it is critically important to make the judiciary not only independent of the government, but also accountable to the people. the survival of multipary democracy and the challenge of national reconcilliation in ghana.pdf
With independence came the hope that a system of multi-party democracy would be firmly established in Ghana. Unfortunately, this was a vain hope. Those whose hands the power fell did not believe in political pluralism. Opposition to the Government was not tolerated and was actively stifled because the Government was committed to Marxist or Communist principles. As a result of these developments, Ghana missed the opportunity to develop firm foundations for multi-party politics. The advent of the Constitution of the Fourth Republic therefore offers to the people of Ghana a unique opportunity to build those institutions and develop the traditions, which alone can ensure a lasting democratic order. the right to information bill 199(draft)(o.p 19)justice p.d anim.pdf
This paper aims to direct the attention of Parliament to the need for a law governing the right to information. It is also intends to assist Parliament by providing it with a model. This model will sharply focus Parliament's attention on the specific provisions. It should help Parliament to move expeditiously in the direction of passing a suitable law on the right to information. Adopting this draft, subject to any necessary modification, should perhaps be a suitable first step. There are indications that Government is not averse to the passage of such a law. Justice P.D. intellectuals and government a tale of uneasy partnership.pdf
Professor Yankah provides a historical overview of the mutual mistrust underlying the relationship between government and intellectuals in Ghana. He notes that intellectuals have perceived governments and politicians as semi-qualified self-seekers who must be closely monitored while governments have tended to regard intellectuals as adversaries\whose frequent and partisan attacks on government policy must be curbed in the interest of social stability, and undertakes a thoughtful analysis of the rather checkered relations between post-colonial Ghanaian governments and the nation's intellectuals. This paper by S.K. Apea examines the characteristics of an independent Central Bank. It begins by outlining what the features of a statutorily independent Central Bank should be, by drawing on the experiences of the New Zealand Reserve Bank, the German Bundesbank, the US Federal Reserve, and the European Central Bank. It also states why de-jure independence is necessary for monetary policy credibility, especially for countries with poor inflation history and governments who do not have a good track record for financial restraint. The author tries to explain Cote d'Ivoire’s story using the tools of political economy. In doing so, the author realises that a more comprehensive understanding of Cote d'Ivoire's experiences will require insights not just from political economy, but also from political culture and even psycho-analytical studies of Ivorian political elites. ghana's agricultural sector and prospects for the future by carol levin (o.p 15).pdf
The essay examines the performance of Ghana's agricultural sector before and after the Structural Adjustment Programme. It reviews past and present policies of the sector and its contribution to Ghana's Gross Domestic Product (GDP). Dr. Levin concedes that national agricultural policies have been generally development-oriented and that broad macroeconomic policy reforms have ended the long-term economic decline of the 70's and early 80's. She however identifies a number of factors which negate, or at least inhibit, the growth of the agricultural sector. They include incomplete data coverage, underutilized and or inaccessible data, government squeeze on credit availability to farmers, obsolete technology, limited use of fertilizer, and an inefficient marketing system.
